Extraordinary Alien Requirements

Those petitioning in this category are required by the INS to submit evidence of:

One time major international award, or,

Evidence of three of the following:

  Receipt of lesser national or international prizes.
  Membership in associations in a field which requires outstanding achievement as judged by recognized national or international experts.
  Published material about petitioner in a professional or major trade publication.
  Participation (either individually or on a panel) in judging the work of others.
  Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance.
  Authorship of scholarly articles in field.
  Exhibitions or performances of artistic work.
  Leadership, or major/critical contributions in distinguished organizations or establishments.
  High salary or payment for services.
  Commercial success in the performing arts.

If the above definitions are not readily met, comparable evidence of achievement should be submitted to establish eligibility.


This letter sets out the regulations for the extraordinary alien case and recommends the needed documentation. Requirements and Definitions are quoted from Regulations 8 CFR 204.5(h).


Biographic Information

In order to prepare the forms, my office will need:

Your full name as it appears in passport.

Your name as you use it professionally (explain if different from above).

Your date and place of birth.

Your nationality.

Your address.

Your place of employment, position and salary.

Note: additional biographic information and documentation will be needed in order to process you for permanent residency/immigrant visa. The information requested here is needed to complete the first set of INS forms. Requests for additional information and documentation will be sent under separate cover.

NOTE
Both INS and our office need all documentation, papers, letters and basic information in English. Essential papers, articles, chapters that are referenced must be translated into English. Original language work may be submitted as representations of work when not referenced in the other supporting materials. Collecting this evidence prior to contacting us will expedite the process.
