Family-Based Immigration

Marriage to a U.S. citizen

A bona fide marriage to a U.S. citizen usually results in approval of an application to adjust status to Legal Permanent Resident (LPR).

Spouses and children accompany those employed in the United States

Spouses or children coming with the employee acquire the same status.

Parents, spouses and children of U.S. citizens

Visas are immediately available in this category.

Other family based members

Parents, spouses and children of permanent residents are also afforded benefits by immigration laws. However, all these categories are subject to annual limitations and are backlogged. This means permanent residents will have to wait many years for close relatives, such as married children. The following link is to the Department of State. Go to the visa bulletin for more information on these categories. Note that brothers and sisters are also provided benefits. The backlogs in this category however are so long it is rarely used.
