Professionals, Skilled workers, and other workers Requirements

Alien Employment Certification, U.S. Department of Labor

Professional status is established by advanced degrees; exceptional ability; demonstration of a Bachelor of Arts or a Bachelor of Science plus five years of progressive experience in a given field, and a salary that meets the prevailing wage experience level for a position in the given region, as determined by the Department of Labor. Employers may file an application with the United States Department of Labor on behalf on an employee.

Principally, this is a channel for employers to petition on behalf of an applicant after the employer has demonstrated that a six-month search for U.S. citizens or Legal Permanent Residents was unsuccessful, or when the occupation is designated in short supply.

However, any individual - generally skilled - workers may also use this category. Education, skill level, and short supply designation prioritize visa grants.
